Definitions

The following terms and conditions apply to your use of the FineOWine website and service (henceforth the Service). By accessing and using the Service, you agree to be bound by all of the following Terms and Conditions and Privacy Policy.

  • “Content” means any software, data, information, pictures, graphics, and other materials published or made available on the Website, including any third-party content and any user-generated content.
  • “Service” means the use of the FineOWine website and corresponding ordering, payment, and delivery services offered in accordance with these terms.
  • “We”, “our”, and “us” means Sri Krishna Sai Limited together with our successors and permitted assigns.
  • “Website” means the FineOWine site at fineowine.co.nz and any associated domains.
  • “You” and “your” means you, our customer or user of our Website, whether as a member or as a guest.

Ordering

  • Use of this website is restricted to persons 18 years of age or older.
  • You confirm that both the buyer and the recipient of the alcohol are aged 18 years or over at the time of purchase and delivery.
  • It is your responsibility to show a current legal identification to the person making the delivery. If ID cannot be provided, the delivery will be refused, and a cancellation fee may apply.
  • FineOWine requires you to register with a valid email address and proof of identity to purchase. By registering, you agree that FineOWine can contact you via email.
  • The order total includes the price of the product(s) ordered and GST. FineOWine reserves the right to update prices at any time.
  • FineOWine does not guarantee delivery within a specific timeframe but will endeavor to deliver as soon as reasonably possible.

Cancellations and Denials

  • An order may be canceled at any time prior to dispatch. If the order has already been dispatched, a delivery fee and a restocking fee of $10.00 will be deducted from the refund amount.
  • The courier reserves the right to refuse delivery if:
    • The recipient fails to provide valid ID upon request.
    • The recipient appears intoxicated.
    • The delivery location is deemed unsafe.
  • Products cannot and will not be left unattended under any circumstances.
  • Refunds will be processed within 5 working days into a nominated bank account. Refunds will not be provided for change-of-mind cancellations.
  • Orders may be canceled within 20 minutes of placement, provided the courier has not yet been dispatched.

Legal Age Verification

  • By purchasing alcohol through our website, you confirm that both the buyer and recipient of the alcohol are 18 years of age or older.
  • As part of the purchasing process, customers must confirm their age at site entry and again at checkout by ticking a verification box.

Delivery Policy

  • The buyer is responsible for ensuring that an eligible recipient is present to accept the delivery.
  • If a valid ID cannot be presented, the courier will not complete the delivery, and re-delivery fees may apply.
  • FineOWine and its delivery partners are not liable if alcohol is received by a person under 18 due to false or misleading information provided at the time of purchase.
  • Alcohol will not be delivered to intoxicated persons.
  • Delivery times may vary. While FineOWine aims for timely delivery, no guarantees are provided.

Content and Intellectual Property

  • All copyright and intellectual property rights in the text, images, and other materials on this Website belong to FineOWine or are used with permission.
  • The trademarks, logos, and service marks displayed on this Website are owned by FineOWine. Unauthorized use is strictly prohibited.

Liability Disclaimer

  • To the maximum extent permitted by law, this Website is provided on an “as is” and “as available” basis.
  • FineOWine makes no warranties regarding uninterrupted access, accuracy of content, or security of the website.
  • FineOWine is not responsible for any losses or damages arising from:
    • Use or inability to use the Website.
    • Changes in pricing or availability of products.
